Am I required to take an EMA course?
As soon as you receive a letter from the CBR, participation is mandatory. If you do not participate in the EMA course, your driver’s license will be declared invalid.
Driver’s license confiscated due to alcohol: how the process works
When your driver’s license is confiscated by the police, it will be sent to the Central Processing Unit of the Public Prosecution Service (CVOM) within three days. The CVOM is located in Utrecht. You will receive a receipt stating that you have the right to file an objection with the public prosecutor. If your driver’s license was confiscated due to alcohol, the public prosecutor will decide whether it will be withheld for a longer period. The prosecutor decides within ten days on the timeframe for returning your driver’s license. Please note: This does not mean that you must actually receive the letter from the prosecutor within those 10 days.

Therefore, we recommend filing a formal letter of complaint (klaagschrift) as soon as possible. Once a complaint is filed, a court hearing is scheduled within fourteen days. Through this procedure, the court is formally requested to return your driver’s license to you immediately. During the hearing, the judge will determine whether your license can be returned right away. Both the judge and the public prosecutor are present at the hearing, and a ruling is issued immediately. Appealing this decision is not possible, which makes a strong, well-drafted letter of complaint absolutely crucial.
During this hearing, the judge will weigh the interests involved. It will be determined whether your personal interest in getting your driver’s license back outweighs the interest of general road safety.
