10-Day Decision Period for the Public Prosecutor Upon License Confiscation

The obligation to make a decision within the 10-day period is stated in Article 164, paragraph 6 of the Road Traffic Act (Wegenverkeerswet). Article 164, paragraph 6 of the WVW states: “If the public prosecutor does not exercise the authority referred to in paragraph four within ten days after the day of confiscation, they must return the confiscated documents to the holder without delay. (..)” If the final day of the 10-day period falls on a Saturday, Sunday, or a public holiday, the deadline is extended to the following Monday or the next working day if it concerns a recognized public holiday.

Exceeding the speed limit by more than 30 km/h is recorded on your criminal record for a period of 10 years.

How long is the driver’s license suspended for at different speeds?

For speeding offenses, the driver’s license is suspended according to the table below.

EMG, the Educational Measure on Behavior and Traffic

The Educational Measure on Behavior and Traffic (EMG) is a mandatory course imposed on drivers who have exhibited risky behavior on the road. If you have committed a severe speeding violation, displayed dangerous driving behavior, or committed multiple consecutive traffic offenses, you may be required to take this course.

Behaviors that fall into this category include cutting off other road users, driving significantly over the speed limit in built-up areas, running a red light, or tailgating.

During this course, you will learn how to participate safely in traffic and what the consequences and risks of irresponsible behavior are. You will take this course in a group of eight to twelve participants, and you will also be given a homework assignment.

LEMG, the Light Educational Measure on Behavior and Traffic

During the Light Educational Measure on Behavior and Traffic (LEMG), you will learn about the consequences and risks of irresponsible driving behavior. You will be given a homework assignment and typically complete the course alongside eight to twelve other participants.

Driver’s license confiscated due to speeding: how the process works

If your driver’s license has been confiscated by the police, we can help you draft a formal letter of complaint (klaagschrift). After confiscation, your driver’s license will be sent to the Central Processing Unit of the Public Prosecution Service (CVOM) in Utrecht within three days. You will also receive a receipt stating that you can file an objection against the confiscation with the public prosecutor.

The public prosecutor will decide within ten days whether your driver’s license will be withheld for a longer period or if it will be returned to you. We strongly advise against waiting out these ten days. It rarely happens that the Public Prosecutor returns your driver’s license after just 10 days. Therefore, we recommend filing a formal letter of complaint as soon as possible.

Once a formal complaint is filed, a court hearing is scheduled within fourteen days. Through this procedure, the court is formally requested to return your driver’s license to you immediately. During the hearing, the judge will determine whether your license can be returned right away.

Both the judge and the public prosecutor are present at the hearing, and a ruling is issued immediately. Appealing this decision is not possible. Therefore, it is highly in your interest to have a strong, well-drafted letter of complaint!

During this hearing, the judge will weigh whether your personal interest in getting your driver’s license back outweighs the interest of general road safety. Traffic lawyers often see that complaint procedures are successful, especially when there is a high dependency on the driver’s license (for example, in relation to your work).

Often, the justice department initially aims for a suspension lasting several months. However, after filing a formal complaint, the court frequently overturns this, and the driver’s license is returned immediately.

It is important to know that immediately after submitting the complaint, we request the public prosecutor to return the driver’s license. We file complaints when there is a high probability that you will get your license back, and we notify the prosecutor of this. This often results in the driver’s license being returned without even needing a hearing.

This is done from the perspective of efficiency: after all, scheduling a hearing is cumbersome if the prosecutor already knows that the judge will most likely order the return of the driver’s license anyway.
