If you exceed the legal breath alcohol limit, you will face a CBR procedure. Although you can theoretically file an objection through a formal complaint procedure (klaagschrift), this will not yield any results. Once you have completed the psychiatric evaluation, we can assist you.
Have you not yet received a notice from the CBR regarding driving under the influence? At this moment, your only option is to wait until you have completed the evaluation. (Even if the letter from the CVOM states that you can file a formal complaint!). Only after that can further steps be taken.
A CBR procedure will take about 3 to 4 months. There is no state-funded (pro bono) legal aid available for this:
You will receive a letter from the CBR within 8 weeks after your license is confiscated, and you will have to attend an interview with a psychiatrist. An investigation into potential alcohol abuse will then be conducted.
Based on this investigation, the CBR will make a decision. The following steps will then apply:
- As soon as the CBR’s decision is received, we can investigate your chances of success based on your case file and submit a pro forma objection against that decision.
- If we estimate your chances to be favorable, we can draft an objection against the psychiatrist’s evaluation.
